B&C Defense Verdict Affirms Employee Responsibility Under Family Medical Leave Act (FMLA)

B&C attorneys Susie Ingold and Sarah O’Keefe, and paralegal Debra Wedlake obtained a defense verdict in an employment case for our client, an Arizona based company, after it was sued by a former employee.  Following a five-day jury trial, the jury found in favor of our client on the plaintiff’s claim of violation of the Family Medical Leave Act, or FMLA. 

The plaintiff claimed that her former employer interfered with her rights under the FMLA, but a jury found otherwise and awarded her no damages. 

Plaintiff claimed more than $1 million in back pay, front pay and liquidated damages.  With the complexities of FMLA rights and covered employers, this verdict validates employee responsibilities under the FMLA that cannot be shifted to the employer.
