B&C Attorneys Prevail in Easement Rights Case

Published on in Firm Highlights

In late September, real estate litigation attorneys at Burch & Cracchiolo won a 6-day trial involving legal access.  Led by Andy Abraham, Bryan Murphy and Casey Blais, the team successfully proved their client had easement rights to access residential property on Camelback Mountain.

Various neighbors defended the case arguing he had no access rights. The case involved numerous legal theories and defenses, including common law dedication, implied way of necessity, and private way of necessity.  The court also stated that B&C's client could apply to recover its attorneys' fees and costs.
